Acceptable Use Terms and Conditions
Bright Arrow provides domain registration, web hosting, mail hosting, database services and URL forwarding.
By using these services, you agree to be bound by the terms and conditions; you agree to indemnify Bright Arrow from any loss, liability, claim, damage and expense arising from or related to your content or use of any services provided by Bright Arrow. If you are not satisfied with these terms and conditions then you must discontinue use of our hosting services.
Bright Arrow may revise these terms and conditions from time to time by posting a new version of this document on our hosting site www.brightarrow.com.au Any new version of these terms will be effective within 14 days of posting unless Bright Arrow considers (in its sole discretion) that a period shorter than 14 days is necessary to protect the integrity, security or smooth operation of Bright Arrow services. As such, users should consult this document on a regular basis to ensure that they are familiar with the most recent version.
You accept legal responsibility for use of the account, are at least 18 years of age or (if younger) have your parent’s or legal guardian’s permission before using our services.
The hosting services must not be used for unlawful purposes. Any use of these services which violates any local, state, federal or international laws applicable to Bright Arrow in your jurisdiction, or any jurisdiction that your site is subject to is strictly prohibited.
You agree that use of our services is at your own risk. The services are provided by Bright Arrow Australia on an “AS IS” and “AS AVAILABLE” basis. Bright Arrow expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
No advice or information, whether oral or written, obtained by you from Bright Arrow, its employees or associates or through their respective websites shall create any warranty not expressly stated in these terms and conditions.
Bright Arrow reserves the right to take action, including legal or suspension of or termination of a service, against a customer who interferes with the rights of another user online, or attempts to interfere with the smooth running of the internet or Bright Arrow’s services. We reserve the right to discontinue, without refund or notice, any account or service where usage of the account or service is deemed to be an abuse, and we will charge the customer for costs incurred by any such abuse.
You are responsible for any misuse of our services, whether by a friend, family member, guest, employee or customer with access to your account or website. You are also responsible for any such misuse regardless of whether it was with or without your consent. Therefore, you must take steps to ensure that others do not gain unauthorised access to your account or website.
Bright Arrow reserves the right to refuse or discontinue service to anyone at our sole discretion without notice. Your access to all or part of our services may be denied without notice if Bright Arrow believes any of the terms and conditions have been violated.
In the event that you fail to make payment on any account, according to the terms of that account, related to the delivery of web, email or sms services, Bright Arrow reserves the right to immediately suspend access to all digital marketing services being provided to you.
This may include:
• suspension of email
• suspension of editing privileges for website
• suspension of website visibility on the world wide web
• deactivation of hosted email and sms marketing services
• cancellation of hosted website and email services
Should you continue to with-hold payment for a period of more than one month from the time an account falls due, Bright Arrow reserves the right to completely terminate all services, and to seek restitution of all outstanding funds through a court of law.
Any fees associated with the collection of funds outstanding under the terms of your agreement will be payable by you.
All prices quoted are in Australian dollars.
Bright Arrow will automatically renew your hosting service. You acknowledge that if you do not wish to continue with your hosting service, it is your responsibility to request cancellation of your service before it is automatically renewed.
You understand that you must maintain your own copy of any content published via a Bright Arrow service and that Bright Arrow should never be used as any “master” or primary or critical copy of any content.
You understand that no intellectual property rights are assigned to you in the use of a service provided by Bright Arrow unless otherwise specifically contracted.
Likewise none of your intellectual property rights are assigned to Bright Arrow via the use of a service provided by Bright Arrow unless otherwise specifically contracted.
Bright Arrow hosting services are intended to be used for conventional web sites, you shall not use your hosting account as a repository, archive or storage area for files and/or material that is not specifically used by and accessible through the web site associated with your account.
Only one hosting refund per customer, refunds exclude all domain registration fees.
All Bright Arrow hosting accounts have a limit of 50,000 files or inodes.
Bright Arrow, at it’s sole discretion, shall suspend any account that uses a MySQL database which we deem to be excessive. As a guide only, you must not have databases larger then 500MB in size.
You understand that the email services provided with your hosting account are not to be used as a long-term archive. You must download all email collected by your account to your own computer as it arrives, you must not keep emails on our servers for more than 60 days.
You understand that the hosting service we provide is a ‘shared hosting’ service, and as such, your account will be deemed to be using excess resources, and therefore suspended without notice, if it uses up more than 10 times the average daily usage of any resource of the server it is on.

Support
Bright Arrow warrants that the software will perform substantially in accordance with this written document.
Software maintenance and support will be provided from 9 am to 5 pm Monday to Friday (excluding public holidays) for the period covered by any maintenance contract or for any period or condition covered by separate agreement.
Monthly Technical support will consist of unlimited free email support for issues covered by our Service Level Agreement (SLA).
Support tickets can be lodged at brightarrow.com.au/support. Support tickets will be responded to within a maximum period of twenty four hours – or the next business day. 24 hour response time is assured. In most cases, support request will actually be responded to within 4 hours, but the maximum response time will never be more than 24 hours if the support request is submitted through brightarrow.com.au/support.
Note: Questions around how to use the software that have been covered on the training video are not covered under this arrangement.
Any effort expended beyond our standard level of support covered under our Terms and Conditions and Service Level Agreement is charged at the rate of $A95/hr. Additional tech-support tickets for support not covered by our SLA may be lodged, and responses will be billed at $95 +gst per hour, billable in a minimum of fifteen minute increments.
Technical support issues that are the responsibility of Bright Arrow or its affiliated service providers will be provided at no charge to the client.
All technical support services will be provided by Bright Arrow and payable directly to Bright Arrow.
